Agreement

By accessing the Zero-Day Zen website or participating in our programs (the “Services”), you agree to these Terms. If you do not agree, do not use the Services.

What we do (and don’t)

We provide educational coaching and related materials. We do not provide medical, psychological, or legal advice. Our content is for general informational purposes only and not a substitute for professional care.

Accounts & communications

Provide accurate information and keep credentials secure. You consent to receive necessary Service emails (transactional). Marketing emails are opt-in and can be unsubscribed.

Acceptable use

Don’t misuse the Services (e.g., reverse engineer, attempt unauthorized access, disrupt, or violate law). Don’t upload confidential company data unless your organization has authorized that disclosure.

Program logistics (pilot & workshops)

Schedules, formats, and availability may change. We may reschedule or cancel sessions for cause (e.g., facilitator illness, force majeure); you’ll be offered a new date or a refund/credit where applicable.

Payments & refunds (if applicable)

Fees and billing terms will be shown at checkout or in an order form. Unless stated otherwise, all fees are due upfront and are non-refundable once a program begins.

Intellectual property

All content, materials, and trademarks are owned by ZDZ or our licensors. We grant you a limited, non-transferable license to use materials internally for your team’s professional development. No redistribution or commercial resale without written permission.

User submissions & feedback

If you provide feedback or testimonials, you grant ZDZ a non-exclusive license to use them (with your consent if identifiable), including for de-identified, aggregated outcomes reporting.

Third-party links

We’re not responsible for third-party sites or their practices.

Disclaimers

Services are provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, ZDZ and its personnel will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the program giving rise to the claim (or $100 if none).

Indemnification

You agree to indemnify ZDZ for claims arising from your misuse of the Services or violation of these Terms.

Governing law & venue

These Terms are governed by the laws of New Hampshire, USA, without regard to conflicts rules. Exclusive venue is state or federal courts located in New Hampshire, except where your local law provides otherwise and cannot be waived.

Changes to Terms

We may update these Terms; continued use means you accept the changes.
